This Confidentiality policy for personal data (hereinafter referred to as Privacy Policy) applies in respect of all the information that the ISS Art might receive from User. ISS Art includes the ISS Art website available at https://issart.com.
1. DEFINITION of TERMS
1.1. In this Policy the following terms are used:
1.1.2. “Personal data” is any information relating to a directly or indirectly definite or defined natural person (personal data subject).
1.1.3. “Personal data processing” is any action (operation) – or an aggregate of actions (operations) performed using or not using automation tools to personal data, including collection, recording, systematization of personal data, accumulation, storage, specification (update, change), extraction, usage, transfer (distribution, provision, access), anonymization, blocking, deletion, elimination of personal data.
1.1.4. “Personal data confidentiality” is a requirement that must be observed by the Operator or any other people who gain access to personal data to prevent their distribution without the data subject’s consent or without other legal grounds.
1.1.5. ISS Art website user (hereinafter referred to as User) is a person with the access to the ISS Art website by means of the Internet and using this service.
1.1.6. IP address is a unique network address of the computer network node built according to the Internet Protocol.
2. GENERAL PROVISIONS
2.1. By using ISS Art website, you agree to this Privacy Policy and conditions of the User’s personal data processing.
2.2. If you do not agree with these terms, then please don’t use ISS Art website.
2.3. This Privacy Policy can only be applied to ISS Art website. ISS Art does not control and shall not be liable for the third parties’ websites which User can access by following links at ISS Art website.
2.4. ISS Art website developers do not check the personal data provided by a ISS Art website User for accuracy.
3. SCOPE OF PRIVACY POLICY
3.1. This Privacy Policy sets forth ISS Art website developers’ obligations of nondisclosure and confidentiality for personal data provided by User upon ISS Art website developers’ request during registration with ISS Art website.
3.2. Personal data allowed to process under this Privacy Policy are provided by User when he is using ISS Art website (namely during registration of ISS Art website account) and include the following information:
3.2.1. User’s name;
3.2.2. User’s email;
3.3. Any other personal data not specified above should be kept secure and undisclosed except for the cases specified in provision 5.2 hereof.
4. PURPOSES OF PERSONAL INFORMATION COLLECTION
4.1. ISS Art website developers can use User’s personal data for the following purposes:
4.1.1. ISS Art website registered User identification.
4.1.2. To grant User access to personalized ISS Art website resources (in particular, access to information about project costs in Portfolio).
4.1.3. To set up User’s feedback including notifications, inquiries concerning ISS Art website functioning, services, user’s inquiries and requests handling.
4.1.4. To find User’s position to prevent fraud and provide security.
4.1.5. To confirm User’s personal data completeness and accuracy.
4.1.6. Provide User with effective customer and technical support in case of any problems that arise when using ISS Art website.
4.1.10. To provide User with new product offers, special offers, price lists, news feed or other information from ISS Art on User’s consent.
4.1.11. Organize advertising campaigns upon User’s consent.
5. WAYS AND TERMS OF PERSONAL DATA PROCESSING
5.1. User’s personal data can be processed without time limitations through any legal way including personal data information systems using automation tools or manually.
5.2. User’s personal data can be submitted to authorized governmental bodies of the Russian Federation only on conditions and in order as established by the Russian legislation.
5.3. In case of personal data loss or disclosure ISS Art website developers shall notify User about the loss or disclosure.
5.4. ISS Art website developers shall take all necessary administrative and technical measures to protect User’s personal data against unauthorized or accidental access, removal, change, blocking, copying, distribution or other illegal actions of third parties.
5.5. ISS Art website developers together with User take all necessary measures to prevent damages or other negative consequences caused by a loss or disclosure of User’s personal data.
6. PARTIES’ OBLIGATIONS
6.1. User shall:
6.1.1. Provide personal data necessary to use personalized ISS Art website resources.
6.1.2. Update the personal data provided in case of any alterations thereof.
6.2. ISS Art website developers shall:
6.2.1. Use the data received solely for the purposes specified in provision 4 hereof.
6.2.2. Keep confidential information a secret, not disclose it without User’s prior written consent, not sell, exchange, make public or otherwise disclose User’s personal data except for the cases specified by provision 5.2 hereof.
6.2.3. Take precautions to protect User’s personal data from unauthorized access, including:
make regular updates of services and content management systems;
make regular tests to detect malicious code;
use a dedicated virtual server to host the website.
6.2.4. Block certain Users’ personal data from the moment he applied or from the moment a request was sent by User or his lawful representative or an authorized body for protection of data subject’s rights over the examination period, in case any incorrect personal data or illegal actions detected.
7. LIABILITY OF THE PARTIES
7.1. In case of nonfeasance ISS Art website developers shall be liable for all losses borne by ISS Art website User through the improper usage of their personal data in compliance with the effective law of the Russian Federation except for the cases provided by provision 5.2. and 7.2. hereof.
7.2. In case of loss or disclosure of Confidential Information ISS Art website developers shall not be liable for those if such confidential information:
7.2.1. Became public prior to its loss or disclosure.
7.2.2. Was received from a third party prior to the moment it was received by ISS Art website developers.
7.2.3. Was disclosed upon User’s consent.
8. DISPUTE RESOLUTION
8.1. Before applying to the court to resolve disputes arising from relations between ISS Art website Users and ISS Art website developers, submitting a complaint is obligatory (a written proposal to resolve the dispute).
8.2. Within 30 calendar days from the moment of the receipt of the complaint the receiver of the complaint shall notify the complainant about the results of the complaint examination.
8.3. If the agreement between parties is not reached, the dispute will be handed over to the court of justice in accordance with the effective law of the Russian Federation.
8.4. The effective law of the Russian Federation is applicable to this Privacy Policy and shall govern the relations between ISS Art website developers and ISS Art website Users.
9. ADDITIONAL TERMS
9.1. ISS Art website developers are entitled to make alterations to the current Privacy Policy without User’s consent. All alterations made to the current Privacy Policy shall be available as its version placed at https://issart.com
9.2. New Privacy Policy becomes effective from the moment it is placed on ISS Art website unless otherwise provided by a new version of the Privacy Policy.
